Federal Victim Services

Current Status

Federal crime victim services operate under fragmented statutory framework. Crime Victims' Rights Act (18 U.S.C. § 3771) establishes basic notification rights. Victim and Witness Protection Act (18 U.S.C. § 1512) provides safety protections. VOCA (34 U.S.C. § 20101) funds state victim services. Mandatory Victim Restitution Act (18 U.S.C. § 3663A) requires restitution orders.

Office for Victims of Crime administers VOCA funds ($1.5B+). FBI Victim Services Division provides assistance. USAO Victim-Witness Coordinators handle notifications. BOP operates notification system. EOUSA manages Victim Notification System (VNS).

Current limitations include fragmented notification across agencies. 9% restitution collection rate exists.¹ No unified victim portal operates. Some districts have 1 coordinator per 400+ cases. Limited enforcement of victim rights occurs.

Problem

$1.9B federal restitution ordered annually but only 9% collected.¹ 40% of victims never notified of case status changes.² Victim impact statements submitted in only 60% of eligible cases.³ Victims navigate separate systems for FBI, USAO, Courts, and BOP.

Crime victims seeking notification and participation are affected. Victims owed restitution face collection failures. Victims of violent crimes need safety planning. Families of homicide victims require ongoing support. Trafficking and exploitation survivors need specialized services.

No unified victim registration portal exists. Notification obligations lack enforcement. Restitution collection proves ineffective. Inadequate victim-witness coordinator ratios persist. No mandatory victim input on plea agreements occurs.

No penalty exists for notification failures. Restitution gets written off after insufficient collection efforts. Victim rights violations lack effective remedy. No systematic compliance auditing occurs.

Proposed Reform

Create unified Federal Victim Services Portal (FVSP) at victims.justice.gov. Mandate notification timelines with enforcement. Enhance restitution collection through wage garnishment, tax intercept, and priority status. Double victim-witness coordinator capacity.

Single registration enables all agency notifications. Arrest notification occurs within 24 hours. Charging decision notification happens within 48 hours of indictment or declination. Hearing notice provides 7 days advance warning. Plea notice gives 14 days advance with opportunity to confer with prosecutor. Sentencing notice provides 14 days advance with victim impact statement deadline. Custody change notification occurs within 24 hours. Release notice provides 30 days (non-violent), 60 days (violent), 90 days (life-threatening). Clemency consideration notice gives 60 days advance with opportunity for statement. Resentencing notice provides 30 days advance.

Victim coordinator ratio becomes 1:200 cases. Trauma-informed training certification becomes mandatory. FVSP operates in English, Spanish, and languages representing 80%+ of victim population in each district. BOP wage garnishment allocates 20% of prisoner wages to restitution. Restitution takes priority over all debts except child support. Quarterly restitution collection reporting occurs to victim through FVSP. FBI Victim Specialists operate in each field office. Specialized services exist for trafficking, child, elder fraud, domestic violence, and disability victims.

Disclosure of victim identifying information to defendant without court order is prohibited. Finalization of plea without victim notification is prohibited. Waiver of restitution without victim input is prohibited. Address and contact information disclosure to defendant absent court order for good cause is prohibited.

Mandamus remedy for notification violations under 18 U.S.C. § 3771(d)⁴ requires decision within 72 hours with attorney fees available for prevailing victim. Failure to notify of plea may vacate plea within 14 days if victim input would have affected terms. Failure to notify of sentencing allows victim statement submission post-sentence with court consideration. OVC conducts annual compliance audits of all federal districts with districts below 90% notification compliance subject to corrective action plan. Pattern failures get referred to DOJ Office of Professional Responsibility. Contempt proceedings apply for willful restitution non-payment. Fraudulent transfer liability applies. $10,000 penalty applies to financial institutions failing to comply with garnishment orders. Civil cause of action exists for victim retaliation with compensatory and punitive damages. Sentencing enhancement (2 levels) applies for defendant retaliation against victim. Disciplinary action applies for government employee retaliation against victim exercising rights.

"Victim" means person directly and proximately harmed by federal offense, or in case of homicide, family member as defined in 18 U.S.C. § 3771(e). "Notification" means communication through FVSP, email, text, phone, or postal mail providing case status information required under this Act. "Victim-Witness Coordinator" means USAO employee responsible for ensuring victim notification, assistance, and rights protection throughout federal prosecution. "Trauma-informed" means approach recognizing impact of trauma on victim behavior and needs, avoiding re-traumatization, and providing supportive environment. "Restitution" means court-ordered payment from offender to victim for losses caused by offense, including economic losses, medical expenses, and other compensable harms.
