Digital Ecosystem Governance
Current Status

Current Authority: FCC (telecommunications infrastructure), FTC (unfair/deceptive practices, limited privacy enforcement), NIST (voluntary AI standards), state attorneys general (patchwork enforcement).
Existing Limitations: No federal data privacy law. No binding AI accountability framework. Section 230 immunity shields platforms from most content liability without corresponding transparency obligations. 1996 Telecommunications Act framework cannot address algorithmic systems, data markets, or AI-driven decisions.

Enforcement:
New Digital Markets and Technology Administration (DMTA) within Department of Commerce with technical audit authority, headed by Administrator appointed for five-year term with Senate confirmation. Funded at $500M annually with gatekeeper fee assessment authority
GAO ITC with nine Administrative Law Judges appointed for staggered seven-year terms, removable only for cause. Binding arbitration for individual complaints with statutory damages of $1,000 to $50,000 per willful violation

"High-Risk AI System": An AI system deployed in contexts materially affecting employment, creditworthiness, housing, education, healthcare, criminal justice, biometric identification, or access to essential public services
"Covered Entity": Any entity processing personal data of more than 100,000 U.S. residents annually, deriving more than 50% of revenue from personal data sales, or operating High-Risk AI Systems
"Designated Digital Gatekeeper": A platform operator with more than 50 million U.S. monthly active users, annual U.S. revenue exceeding $25 billion, and DMTA designation based on market power assessment
"Personal Data": Any information identifying, relating to, or reasonably linkable to a particular individual or household, including biometric data, geolocation, browsing history, purchase history, and inferences drawn therefrom
"Algorithmic Impact Assessment": A documented evaluation of an AI system's potential effects including accuracy, bias, transparency, and accountability, conducted per DMTA standards
"Dark Pattern": A user interface design subverting user autonomy, including false urgency, forced action, interface interference obscuring privacy choices, and nagging prompts
What Changes
Before: No federal right to access, correct, or delete personal data with nineteen different state laws creating compliance chaos. GDPR extraterritorial application creates additional complexity for U.S. businesses operating in multiple jurisdictions.
