Current Status
Existing Law: Title VII of the Civil Rights Act of 1964 (42 U.S.C. § 2000e) prohibits employment discrimination based on race, color, religion, sex and national origin. 42 U.S.C. § 3604 (Fair Housing Act) makes it unlawful to refuse to sell or rent, or to discriminate against any person in the terms, conditions, or privileges of sale or rental of a dwelling, because of race, color, religion, sex, familial status, or national origin. The Fair Credit Reporting Act applies where an algorithm is used to deny people employment, housing, credit, insurance, or other benefits. The Equal Credit Opportunity Act makes it illegal for a company to use a biased algorithm that results in credit discrimination on the basis of race, color, religion, national origin, sex, marital status, age, or because a person receives public assistance.
Current Authority: The EEOC launched an "Artificial Intelligence and Algorithmic Fairness Initiative" in 2021 to ensure that the use of software—including AI, machine learning, and other emerging technologies—in hiring and other employment decisions complies with federal civil rights laws. The EEOC is the primary federal agency responsible for enforcing federal non-discrimination laws. The FTC has decades of experience enforcing Section 5 of the FTC Act, which prohibits unfair or deceptive practices, including the sale or use of racially biased algorithms. HUD enforces the Fair Housing Act. Federal banking regulators (OCC, FDIC, CFPB) oversee fair lending compliance.
Existing Limitations: Whether looking at the Civil Rights Act of 1964, the Fair Housing Act, the Voting Rights Act, the Americans with Disabilities Act, or other civil rights statutes, current civil rights laws may not be easily enforced against discriminatory AI. In many cases, individuals may not even know AI was used, deployers may not be aware of its discriminatory impact, and developers may not have tested the AI model for discriminatory harms. "The use of AI tools for hiring procedures is already widespread, and it's proliferating faster than we can regulate it. Currently, outside of a New York City law, there's no regulatory, independent audit of these systems."
Problem
Specific Harm
Employment Discrimination: University of Washington research found that LLMs favored white-associated names 85% of the time, female-associated names only 11% of the time, and never favored Black male-associated names over white male-associated names when ranking resumes. As of 2024, 99 percent of Fortune 500 companies use algorithmic technology to assist with hiring. Over 70% of companies using hiring AI technology invest in the promise of efficiency and neutrality, yet these technologies have the potential to discriminate against protected classes. 492 of the Fortune 500 companies use applicant tracking systems to streamline recruitment and hiring in 2024.
Credit and Lending: Research found that credit scores for minorities are about 5 percent less accurate in predicting default risk than the scores of non-minority borrowers. Likewise, the scores for people in the bottom fifth of income are about 10 percent less predictive than those for higher-income borrowers. One 2021 Journal of Financial Economics study found that borrowers from minority groups were charged interest rates that were nearly 8 percent higher and were rejected for loans 14 percent more often than those from privileged groups. A study by Berkeley researchers found that otherwise equal Black and Latino borrowers were charged more for mortgages, costing them $765M yearly. Additionally, over 1.3 million creditworthy borrowers were denied loans due to factors related to race.
Housing: According to a 2024 Urban Institute analysis of Home Mortgage Disclosure Act data, Black and Brown borrowers were more than twice as likely to be denied a loan than white borrowers. Landlords are increasingly using automated screening programs to evaluate prospective tenants. These programs routinely return incorrect, outdated, or misleading information that landlords use to disproportionately deny applications to Black and Latino renters, worsening housing discrimination and exacerbating racial disparities in the rental application process.
Criminal Justice: ProPublica analysis found that Black defendants were 77 percent more likely to be pegged as at higher risk of committing a future violent crime and 45 percent more likely to be predicted to commit a future crime of any kind, even after isolating the effect of race from criminal history and recidivism. The Justice Department's PATTERN algorithm overpredicts the risk that Black, Hispanic, and Asian people will reoffend or violate their parole. This overprediction means that relatively fewer Black, Hispanic, and Asian incarcerated individuals are eligible for early release than their similarly situated white peers.
Healthcare: Black patients are three times more likely to suffer from an occult hypoxemia that remains undetected by pulse oximeters compared with white patients. Algorithmic bias can fail to account for disparities in healthcare outcomes, such as an overall mortality rate that is nearly 30 percent higher for non-Hispanic Black patients versus non-Hispanic white patients. An AI used across several U.S. health systems exhibited bias by prioritizing healthier white patients over sicker black patients for additional care management because it was trained on cost data, not care needs.
Who is Affected
- Job applicants screened by algorithmic hiring tools (hundreds of millions annually given 99% of Fortune 500 companies use such technology)
- 45 million Americans who are either credit-underserved or unserved who interact with AI lending systems
- Tenants subjected to automated screening in rental markets
- Black applicants called back on average 36% less often than white applicants and Latino applicants 24% less often with identical resumes, according to a 2023 Northwestern University meta-analysis of 90 studies.
- Criminal defendants assessed by risk prediction algorithms across dozens of state jurisdictions
- Patients whose care is determined by clinical AI decision support systems
Gaps in Current Law
Several federal statutes provide for disparate impact liability including Title VII, the Age Discrimination in Employment Act, the Fair Housing Act, and the Equal Credit Opportunity Act. Unfortunately, these provisions are insufficient to guard against many common forms of algorithmic discrimination. Specific gaps include:
- No mandatory pre-deployment bias testing for algorithmic systems in any sector
- No explainability requirements for consequential algorithmic decisions
- No clear developer-deployer liability allocation for algorithmic discrimination
- No private right of action specific to algorithmic harm
- No cross-sector federal transparency standards for AI use disclosure to affected individuals
Accountability Failures
The type of granular information needed to prove algorithmic discrimination would likely not be available to a plaintiff at the relevant stage, if ever, given "trade secret" protections companies claim when it comes to the details of their algorithms. For certain more complex AI tools such as neural networks, even the developer of the tool may not have visibility into all of the features of a certain model. Accordingly, a plaintiff will most likely be in the dark as to whether the algorithm's underlying logic, its training data, or any one of a number of other areas where bias may creep in, caused the relevant discrimination.
According to the EEOC, an employer's use of AI may implicate disparate impact concerns under Title VII. However, the EEOC states that an employer may be responsible for its use of AI tools, even if the tools are developed by a third-party software vendor. This creates confusion about liability allocation and insufficient incentives for developers to test for bias.
Proposed Reform
Primary Policy Change
Establish a comprehensive federal algorithmic accountability framework requiring:
- Mandatory bias impact assessments before deployment of AI systems in high-stakes domains
- Clear liability rules allocating responsibility between AI developers and deployers
- Enforceable transparency and explainability requirements
- Private right of action for individuals harmed by algorithmic discrimination
New Requirements
1. Bias Impact Assessment (BIA) Mandate
All covered entities deploying algorithmic decision-making systems for consequential decisions in employment, credit, housing, insurance, or criminal justice must:
- Conduct independent bias audits prior to deployment and annually thereafter
- Test for disparate impact across protected classes including intersectional categories
- Document methodology, data sources, and results
- Bias audits shall include testing AI tools to assess disparate impact on employment decisions for candidates or employees based on protected categories (e.g., sex, ethnicity, and race). In cases where individuals assessed are not included in the required calculations because they fall within an unknown category, organizations must indicate the number of these individuals.
2. Explainability Standards
For consequential decisions (employment, credit, housing, benefits, criminal justice):
- Deployers must provide affected individuals with principal factors contributing to algorithmic decisions
- As the CFPB has clarified, creditors may not rely on standardized checklists of reasons for adverse action notices if those reasons don't "specifically and accurately indicate the principal reason(s) for the adverse action."
- Technical documentation requirements for high-risk AI systems
3. Transparency and Notice
- Prohibit use of automated decision tools unless the tool has been subject to a bias audit within one year of use, information about the bias audit is publicly available, and certain notices have been provided to employees or job candidates.
- Require disclosure when AI is used in consequential decisions
- Mandate data retention policies be disclosed upon request
4. Sector-Specific Rules
- Healthcare AI: Require clinical validation studies demonstrating performance parity across demographic groups before deployment
- Criminal Justice AI: Mandate judicial transparency requirements; judges must disclose when risk assessment tools inform sentencing or bail decisions
- Employment AI: Extend EEOC Uniform Guidelines on Employee Selection Procedures explicitly to all algorithmic selection tools
5. Developer Accountability
AI developers marketing systems for high-stakes decisions must:
- Conduct pre-market bias testing
- Provide deployers with technical documentation on training data, known limitations, and recommended use cases
- Maintain records of complaints and identified issues
6. Challenger Model Requirement
All automated systems making consequential determinations shall include:
- A distinct "Challenger Model" that reviews primary model decisions using either: (a) different training data, or (b) different algorithmic approach
- If Challenger Model identifies potential error (disagreement with primary model), system must flag determination for human review before final action
- For systems where Challenger Model is technically infeasible (documented justification required and approved by GAO ITC), random 5% of determinations subject to independent human review
Technical Implementation:
- Acceptable Challenger approaches: holdout validation set, adversarial testing, out-of-distribution detection, ensemble disagreement
- Documentation required: Challenger architecture, training differences, disagreement rate, resolution procedures
- Annual calibration: If disagreement rate <1% (models too similar) or >25% (unreliable), recalibration required with GAO ITC notification
- GAO ITC audits Challenger Model implementation in random 10% of covered systems annually
New Prohibitions
- Prohibited: Deploying algorithmic systems in covered domains without completed bias impact assessment
- Prohibited: Using algorithmic systems known to produce disparate impact without demonstrable business necessity and absence of less discriminatory alternatives
- Prohibited: Failing to provide notice to individuals that algorithmic systems are being used to make consequential decisions
- Prohibited: Developers making affirmative misrepresentations about bias testing or system capabilities
- Prohibited: Retaliation against individuals who report algorithmic discrimination or request alternative processes
Enforcement
1. Agency Enforcement
- FTC: Primary enforcement authority for unfair/deceptive AI practices under enhanced Section 5 authority; the FTC has signaled it will use its Section 5 unfairness authority to require reasonable safeguards on the use of automated tools to ensure their accuracy and absence of bias.
- EEOC: Employment AI enforcement under Title VII; EEOC treats employer use of algorithmic decision-making tools as an employment "selection procedure" under Title VII.
- HUD: Housing AI enforcement under Fair Housing Act
- CFPB: Credit and lending AI enforcement under ECOA/FCRA
- Sector Regulators: Banking regulators, FDA (healthcare AI), DOJ (criminal justice AI)
2. Civil Penalties
- Civil penalties of $500 for first violation and each additional violation occurring on the same day; $500 to $1,500 for each subsequent violation. Each day an entity uses AI in violation and fails to provide any required notice shall constitute a separate violation.
- Enhanced penalties for willful violations: Up to $50,000 per violation
- Algorithmic disgorgement: The FTC's authority to order algorithmic disgorgement remains unchallenged.
3. Private Right of Action
- Individuals harmed by algorithmic discrimination may bring civil action
- Available remedies: Actual damages, statutory damages ($5,000-$25,000 per violation), injunctive relief, attorney's fees
- Class action availability for pattern-or-practice claims
- To prevail on a disparate impact claim, plaintiffs need to statistically demonstrate that an algorithm disproportionately harms a protected group and that a less discriminatory practice exists. Discovery rules shall require production of algorithmic documentation to facilitate such proof.
4. Oversight Structure
- GAO: Biennial report to Congress on algorithmic accountability enforcement, compliance rates, and emerging risks
- Inspectors General: Audit federal agency AI deployments for compliance
- Judicial Conference: Develop standards for AI use in federal court proceedings
