Proposed Reform

Definitions:

"AI-enabled unmanned system": An unmanned vehicle, vessel, or aircraft incorporating machine learning algorithms for navigation, targeting, or decision support functions, excluding systems relying solely on pre-programmed flight paths without adaptive capability.

"Autonomous targeting system": Any system using artificial intelligence to identify, track, prioritize, or recommend engagement of military targets, regardless of whether human authorization is required for final engagement decision.

"Domestic manufacturing facility": A facility located within the territorial United States or its possessions, owned by a U.S. person as defined in 31 C.F.R. § 800.251, employing U.S. persons for all security-sensitive functions, and meeting DFARS 252.204-7012 cybersecurity requirements.

"Initial operational capability": The point at which a weapon system is available for deployment in sufficient quantity and with adequate training and sustainment support to be employed in combat operations, as certified by the relevant Service Secretary.

"Peer adversary": A nation-state possessing military capabilities in two or more of the following domains at levels comparable to or exceeding United States capabilities: nuclear weapons, space systems, cyber warfare, hypersonic weapons, artificial intelligence, or autonomous systems. As of enactment, this includes the People's Republic of China and the Russian Federation.

"Human authorization": Affirmative action by a trained military operator to approve a specific engagement after review of targeting data, conducted in real-time or near-real-time, with the operator bearing command responsibility for the engagement under the law of armed conflict⁸ ⁹.
